Terms of Service

Plain-language summary: we build your website and, if you choose, run the online side of your business on a simple monthly plan. You can cancel the monthly plan any time. You own your domain and your finished site once it is paid for. The full terms below govern our work together.
These Terms of Service (“Terms”) are between PXL North (“PXL North”, “we”, “us”) and you, the client (“you”). By requesting a preview, accepting a quote, or using our services, you agree to these Terms.
1. What we provide
- Website build: a one-time project to design, build, and launch your website.
- Monthly plans: ongoing hosting, maintenance, edits, and (on higher plans) SEO, email, social media, and marketing.
- Add-ons: extra pages, online booking, e-commerce, ad landing pages, and custom development (dashboards, POS integration, reporting, and similar), quoted per project.
- Free preview: an optional, no-cost preview of your site (or first design) so you can decide before you commit.
2. The free preview
The free preview is provided at no cost and with no obligation. It is a demonstration only: until you accept a quote and pay, the preview and any design work remain our property, are not licensed for your use or launch, and may be taken down at any time. We only prepare a preview for a business in relation to that business’s own website.
3. Quotes, pricing, and payment
- Prices shown on our site are starting figures. We confirm a fixed quote after the free preview.
- All prices are in Canadian dollars (CAD) and exclusive of applicable taxes (e.g. HST), which are added where required.
- The website build is a one-time fee. Monthly plans are billed in advance each month.
- Third-party costs (for example ad spend, premium plugins, stock media, or domain registration) are billed separately or paid by you directly.
- Late or failed payments may pause work, edits, or hosting until the account is current.
4. Edits and “unlimited” (fair use)
Each plan includes a stated number of content edits per month (for example hours, prices, photos, and small text changes). Where a plan describes “unlimited” edits, this means reasonable, small edits under a fair-use policy, requested one at a time and handled in turn. It does not include new pages, redesigns, new features, custom development, or work that amounts to a new project, which are quoted separately. We may decline or re-quote requests that are excessive or outside the spirit of fair use.
5. Cancellation and refunds
- Monthly plans are month to month. You can cancel any time, effective at the end of your current billing period. There is no long-term contract or cancellation penalty.
- Monthly fees already paid are not refunded for the current period, but you keep service through the period you paid for.
- The one-time build is non-refundable once work has begun, except as required by law. A deposit may be required before we start.
- On cancellation we will help you move your site to hosting of your choice and provide a reasonable export of your content.
6. Ownership
You own your domain name. Once the website build is paid in full, you own the finished website we deliver for your business. We retain ownership of our underlying tools, templates, code libraries, and know-how, and of any preview or work not yet paid for. We may show your launched site in our portfolio unless you ask us not to in writing.
7. Hosting and uptime
Monthly plans include managed hosting so we can keep your site fast, secure, and backed up. We aim for high availability but do not guarantee uninterrupted service unless a specific service level is agreed in writing. We are not responsible for outages caused by third parties, your content, or events beyond our reasonable control.
8. Your responsibilities
- Provide accurate business information and the content, logos, and images you want used.
- Confirm you have the rights to any materials you give us, and keep your site’s content lawful and accurate.
- Use the services only for lawful purposes and not to send spam or unlawful messages.
9. Third-party services
Some services rely on third parties (for example Google, social media platforms, payment processors, and advertising networks). Their use is subject to their own terms, and we are not responsible for their decisions, pricing, or availability.
10. Warranties and liability
We provide our services with reasonable care and skill. Except as required by law, services are provided “as is” without other warranties. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the services in the three months before the claim, and we are not liable for indirect or consequential losses such as lost profits or revenue.
11. Termination by us
We may pause or end services for non-payment, misuse, or breach of these Terms. Where reasonable we will give notice and a chance to fix the issue.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules.
13. Changes to these Terms
We may update these Terms from time to time. The “last updated” date shows the current version; continued use after a change means you accept the updated Terms.
